Navigating a Buyer’s Market: What Rights Do Suppliers Have?

The Procurement Act 2023 comes in to force today, 24 February 2025, bringing the most significant reforms to UK public procurement in decades.

Designed to enhance transparency, competition and accountability, the Act introduces new rules that businesses and public sector bodies must navigate.

Here we bring you our Beale & Co Guide, providing you with a practical overview of the Act. Our Guide is designed to assist you in understanding the key provisions of the Act and how it will affect your participation on public procurement.

We have also produced an article, here, detailing five of the most significant changes for you to be aware of, which include: (i) Tougher Exclusion and Debarment Rules, (ii) Integrity and Public Benefit, (iii) Performance Monitoring and KPIs, (iv) More Flexible Procedures and Increased Transparency and (v) Legal Oversight.

We have been helping clients prepare, answering their questions and helping them adapt to the new regime.   Expanded exclusion grounds mean clients must check their compliance policies are still fit for purpose.  Negotiating KPIs (and their enforcement) is another area which businesses have been alive to.  The increased focus towards maximising public benefit has also got companies thinking.

Every procurement scenario is unique and our team is here to help you address specific opportunities, challenges and optimise your tendering strategies.
