The complex and much-debated issue of privilege has tested the grey cells of the judiciary on numerous occasions over recent times and it is likely that it will continue to be a key area for consideration by the Courts. Indeed, after a flux of first instance and Court of Appeal decisions, further guidance from the Supreme Court would be welcomed in due course.

With a number of new cases having hit the senior courts over the past few months, this article pulls together all of the various strands in this complicated area and attempts to summarise the law as it currently stands.
