We are finding that debt collection is one of the biggest issues facing consultants, with payment often remaining outstanding for significant periods (if sums are paid at all) on no proper basis and without proper notice. However, from our experience, those who have complied with their payment notice obligations under the Housing Grants, Construction and Regeneration Act 1996 (“the Construction Act”), or are able to swiftly respond to any failures by the payer to comply with their notice obligations, are usually in a much better position to obtain payment.
In a recent Beale & Company seminar Will Buckby (Partner) and Andrew Croft (Assistant) spoke about consultants’ payment rights on UK projects, with particular focus on the Construction Act.
