Scott specialises in claims and regulatory complaints against lawyers and accountants. Scott acts for a wide variety of firms from sole practitioners to major national and international firms, defending them against claims and complaints brought by a variety of different claimants including lenders, liquidators and litigants in person.

He is recognised as a leading lawyer in Chambers and Partners 2020 having acted in a variety of high value litigated claims and multi-party disputes and is praised by clients for his strong technical ability and clear concise advice even in the most complex of cases.  He has successfully defended claims against professionals to trial in cases ranging from low value small claims track proceedings to multi-million pound claims in the High Court, Commercial Court, TCC and the Court of Appeal.   Scott also has strong experience in all forms of ADR including mediation.

Scott also frequently acts for professional clients facing complaints made to their professional bodies or regulators including the SRA and the ICAEW.  His regulatory experience includes advising firms of solicitors that are the subject of an intervention and investigations by the SRA as well defending individual solicitors before the Solicitors Disciplinary Tribunal. He also has a wealth of experience in representing and advising professionals that are the subject of complaints to Ombudsman services including the Legal Ombudsman and the Financial Ombudsman Service.

Recent and notable cases that Scott has been instructed on, include:

  • Acting for a UK Top 200 law firm in a £5 million dispute regarding the construction of an option agreement as to the treatment of VAT.
  • Acting for a Top 50 UK law firm in a 5 party litigated dispute with a quantum of over £6 million regarding the location and construction of a sub-station.
  • Acting for a firm of solicitors in two closely related pieces of litigation with a combined quantum of over £13 million regarding missed limitation in a claim against a national Bank for mis-selling of interest rate hedging products.
  • Acting for a solicitor in regulatory proceedings before the Solicitors Disciplinary Tribunal facing multiple allegations of breaches of the solicitors account rules and alleged lack of integrity.
  • Acting for a firm of solicitors in the defence of hundreds of claims with a potential combined multi-million pound exposure to insurers relating to failed buyer funded property developments.
  • Advising a national firm of solicitors subject to an Application for third party disclosure and complaints relating to an alleged breach of trust and contempt of court.
  • Representing a firm of accountants and auditors in a claim by a liquidator for £3 million relating to alleged wrongful trading.
  • Representing an Executor and Trustee of a Will in a multi-party litigated claim for £5 million concerning an alleged unlawful means conspiracy.

An expert in insurance coverage and advising insurers on all issues relating to policy response, Scott also has experience of running and managing claims handling services for insurer clients.
